These Terms & Conditions govern access to and use of the OPUNÉ® website, including technical inquiries, sample requests, pre-registrations, feedstock submissions, research requests, and other preliminary communications submitted through the website.
Use of this website does not create a commercial relationship, supply obligation, development commitment, partnership, representation, agency relationship, or contractual entitlement unless expressly confirmed in a separate written agreement executed by an authorized representative of the relevant contracting parties.

Submitting information through this website does not constitute a purchase order, supply contract, binding quotation, commitment to manufacture or supply, reservation guarantee, technical approval, or grant of exclusivity.
OPUNÉ® retains sole discretion to review, decline, defer, request additional information regarding, or discontinue consideration of any submission. No preliminary communication or automated response constitutes an offer capable of acceptance unless expressly identified in a written agreement signed by an authorized representative.
3. Technical Requests, Specifications & Development Discussions
Technical requirements submitted through this website are treated as preliminary evaluation inputs unless otherwise agreed in writing. Submission of specifications does not constitute confirmation that OPUNÉ® can manufacture, reproduce, scale, supply, or commercially deliver a material meeting those requirements.
Material development remains subject to technical feasibility, formulation compatibility, feedstock characteristics, process conditions, testing requirements, applicable regulations, and commercial viability. Technical parameters discussed before execution of a formal agreement may change during evaluation and must not be treated as final product specifications.
4. Sample Requests & Material Evaluations
A request for a sample, swatch, prototype, development material, pilot batch, or evaluation quantity does not create an obligation to provide material. Where material is made available, its transfer, handling, testing, disclosure, reproduction, destruction, return, and permitted use may be governed by a separate Material Transfer Agreement (MTA) or Non-Disclosure Agreement (NDA).
Unless expressly agreed otherwise in writing, evaluation materials are provided solely for internal assessment and must not be commercially sold, resold, reverse engineered, chemically deconstructed, or used for production manufacturing. Receipt of evaluation material does not grant ownership of its underlying formulation, process, or intellectual property.
5. Pre-Registrations & Pilot Allocation Requests
Any pre-registration, pipeline material interest submission, pilot allocation request, or expression of commercial interest represents a preliminary request for consideration only. A pre-registration does not reserve production capacity, secure material allocation, establish priority rights, create exclusivity, or guarantee future access to a material.
OPUNÉ® may modify, defer, suspend, discontinue, or decline any development pathway or material evaluation without liability arising solely from a preliminary registration or expression of interest.
6. Feedstock & Biomass Supplier Submissions
Agricultural residue, biomass, crop by-product, or feedstock submissions are preliminary expressions of supply interest. Submission of information regarding available biomass does not constitute acceptance of the supplier, confirmation of procurement, agreement to purchase, confirmation of price, or commitment to collect material.
Any potential procurement arrangement remains subject to separate evaluation regarding physical condition, moisture characteristics, purity, logistics feasibility, and commercial terms. A supplier must not represent itself as an approved or contracted OPUNÉ® supplier unless confirmed through an authorized written agreement.
7. Intellectual Property & Proprietary Know-How
OPUNÉ®, its associated brand identifiers, website content, material concepts, technical documents, visual assets, interface architecture, product descriptions, proprietary terminology, formulations, processes, and data structures are protected by applicable law. No website content grants any express or implied licence to use, reproduce, modify, distribute, register, reverse engineer, or commercially exploit proprietary material without prior written authorization.
Technical information disclosed publicly should not be interpreted as complete disclosure of underlying material architecture, chemistry, processing conditions, or trade secrets. Any rights relating to intellectual property remain reserved.
